Law Enforcement Request Policy

Introduction

ENDsun Services, LLC d/b/a LoyalFans (“LoyalFans”) takes user privacy, safety, and legal compliance seriously. This policy describes the process for submitting and handling valid law enforcement and other government authority requests for user data or content removal. It applies only to requests from law enforcement or other governmental authorities and should be read alongside our Privacy Policy, Copyright Policy, Complaints Policy, and Acceptable Use Policy.

Scope

This policy applies to legally valid and properly served requests from law enforcement or other competent authorities seeking:

  • Disclosure of user account information or related records.
  • Preservation of user account information pending legal process.
  • Removal or restriction of content pursuant to a lawful order.

Requirements for a Valid Request

To be processed, law enforcement or governmental authority requests must:

  1. Be in writing and issued under applicable law.
  2. Clearly identify the issuing authority, including name, title, and agency.
  3. Provide a valid return email address and telephone number for follow-up.
  4. Specify the legal basis for the request (e.g., court order, subpoena, search warrant, DSA Article 10 order, UK Investigatory Powers Act order, or equivalent).
  5. Describe in detail the information sought or the action requested, including any relevant usernames, email addresses, content URLs, or other unique identifiers.
  6. Include any supporting documentation (e.g., certified court order, warrant).

Cross-Border Requests

Because LoyalFans is based in the United States, we only respond to requests from non-U.S. law enforcement or governmental authorities if they are made through appropriate international cooperation channels recognized under U.S. law, such as a Mutual Legal Assistance Treaty (MLAT) request, a request under the EU Digital Services Act (DSA), or another applicable legal framework. All those requests must originate from a competent authority and include verifiable authentication. LoyalFans will reject any request that does not comply with these requirements.

Requests marked “URGENT” in the subject line will be prioritized if they involve imminent risk of death or serious physical harm.

Processing and Response Times

  • We review each request for legal sufficiency and scope before responding.
  • We may seek clarification or limit the scope if the request is overly broad or disproportionate.
  • Response times vary based on the complexity and nature of the request, but legally mandated deadlines will be met.
  • For requests under GDPR/UK GDPR that relate to personal data, responses will be made in accordance with applicable timelines and restrictions.

Privacy Safeguards and User Notification

LoyalFans values user privacy and only discloses data when legally required. We limit disclosure to what is necessary to comply with the legal request. Unless prohibited by law, we will attempt to notify the affected user before producing their information so they may seek legal remedies.

Transparency Reporting

We publish anonymized and aggregated statistics about law enforcement and government authority requests in our annual transparency reports, including:

  • Number of requests received.
  • Jurisdictions of origin.
  • Categories of data or content affected.
  • Actions taken in response.
