Acceptable Use Policy

These acceptable use standards apply to any material you upload or share to LoyalFans or generate on LoyalFans ("Content"). They also apply to any contact you make with other Users on LoyalFans, links to LoyalFans, and any other ways you use LoyalFans.

You must comply with these standards in spirit and to the letter.

TLFPAY LLC will determine, in its discretion, whether any Content or your use of LoyalFans breaches these acceptable use standards.

You must not use LoyalFans:

• In any way that breaches any local, national, or international law or regulation.
• In any way that is unlawful or fraudulent or has any unlawful or fraudulent purpose or effect.
• To harm or attempt to harm minors in any way.
• To facilitate any transaction other than a Creator Interaction.
• To sell controlled or regulated items.
• To bully, insult, intimidate, or humiliate any person.
• To engage in misconduct that threatens public or personal safety, including unlawful sexual behavior.
• To send, knowingly receive, upload, download, share, post, use, or reuse any material that does not comply with our content standards.
• To transmit, or procure the sending of, any unsolicited or unauthorized advertising or promotional material or any other form of similar solicitation (spam).
• To knowingly transmit any data, send, or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware, or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.
• To share other people's personal data.
• To scrape, download, share, or gather information from LoyalFans or any Creator for any reason.

Content:

• Must be accurate (where it states facts).
• Only contain opinions that are genuinely held.
• Must comply with the law applicable in any country from which it is posted and to which LoyalFans is targeted.
• If AI-generated, must be clearly and conspicuously labeled as such, using a signifier like #ai or #AIGenerated.

Content must not:

• Be defamatory of any person.
• Be obscene, offensive, hateful, or inflammatory.
• Infringe any copyright, database right, or trademark of any other person.
• Be likely to deceive any person, including misleading descriptions of media or account information.
• Breach any legal duty owed to a third party, such as a contractual duty or a duty of confidence.
• Contain illegal content or promote any illegal content or activity, including actual, claimed, or role-played: exploitation, abuse, or harm of individuals under the age of 18; incest; bestiality; necrophilia; or rape or sexual assault.
• Contain prohibited bodily fluids including urine or excrement.
• Be in contempt of court.
• Be threatening, abusive, or invasive of another's privacy, or cause annoyance, inconvenience, or needless anxiety.
• Be likely to harass, upset, embarrass, alarm, or annoy any other person.
• Impersonate any person or misrepresent your identity or affiliation with any person.
• Give the impression that the Content emanates from TLFPAY LLC, if this is not the case.
• Advocate, promote, or incite any party to commit, or assist in committing, any unlawful or criminal act such as (by way of example only) copyright infringement or computer misuse.
• Contain a statement that you know or believe, or have reasonable grounds for believing, that members of the public to whom the statement is, or is to be, published are likely to understand as a direct or indirect encouragement or other inducement to the commission, preparation, or instigation of acts of terrorism.

Illegal Content

In addition, you must not use LoyalFans in any way that involves the following:

• Terrorism, including advocating, promoting, or facilitating acts of terrorism.
• Child sexual exploitation or abuse, including grooming and child sexual abuse material (CSAM).
• Hate offenses, including the use, promotion, or distribution of content that incites violence or hatred against individuals or groups based on protected characteristics such as race, religion, nationality, ethnicity, sexual orientation, gender identity, or disability. This includes hate speech, symbols associated with hate groups, and material that promotes or glorifies extremist ideologies.
• Harassment, stalking, making threats, or abuse, including repeated unwanted contact, doxxing, intimidation, or targeting someone based on their identity. Content must not depict or encourage real-world harassment or abusive behavior. Consensual roleplay is permitted but must not cross into behavior that could reasonably be seen as threatening or harmful.
• Controlling or coercive behavior, including any content that depicts, promotes, or encourages non-consensual domination, manipulation, intimidation, or isolation of another person. This includes threats, blackmail, monitoring or restricting someone's movements, or pressuring someone into sexual activity or submission without their clear and ongoing consent. While consensual BDSM, roleplay, and power exchange dynamics are permitted, all that content must reflect informed, enthusiastic, and revocable consent. Content that may reasonably be understood to depict or normalize real-world abuse, coercive control, or domestic violence is prohibited under applicable law.
• Intimate image abuse, including the sharing of non-consensual, fake, manipulated, or otherwise unauthorized intimate images.
• Extreme pornography, meaning any content—whether real or simulated—that shows acts which could seriously harm someone, threaten a person's life, involve sex with animals, or involve a human corpse. This includes content that may be considered grossly offensive, violent, or otherwise obscene under applicable law. Even if the content is fantasy-based or digitally created, it's not allowed if it crosses legal lines.
• Sexual exploitation of adults, including any content that depicts or promotes non-consensual sexual acts, coercion, abuse of power, trafficking, or exploitation of individuals in vulnerable situations (such as through threats, force, manipulation, or economic dependence). All sexual content involving adults must be consensual, legal, and free from exploitation in both appearance and reality. Simulated or roleplay content must clearly reflect informed and voluntary participation.
• Human trafficking, including any content that depicts, facilitates, promotes, or glorifies the recruitment, transportation, harboring, or exploitation of individuals through force, fraud, coercion, or abuse of vulnerability. This includes trafficking for sexual exploitation, labor, or other exploitative purposes. Content must not appear to normalize, eroticize, or trivialize trafficking or exploitation in any form, even in simulated or fantasy-based scenarios.
• Prostitution, including offering or soliciting sexual services in exchange for money, goods, or other value. This includes content that advertises, encourages, or attempts to arrange commercial sexual encounters, regardless of whether the parties involved appear to consent or whether that conduct is lawful in a particular jurisdiction.
• Unlawful immigration, including content that encourages, instructs, or offers assistance in entering, residing, or working in a country illegally. This includes offering forged documents, sharing methods to evade immigration controls, or promoting services that aid unauthorized entry or stay.
• Fraud and financial offenses, including content that promotes or engages in scams, identity theft, payment fraud, money laundering, or misuse of financial information. This includes attempts to obtain payment or personal data through false or deceptive means, or to use LoyalFans for unlawful financial gain.
• Proceeds of crime offenses, including content that involves, promotes, or attempts to use LoyalFans to conceal, transfer, or benefit from money or assets obtained through criminal activity. This includes laundering criminal proceeds, facilitating unlawful transactions, or using funds derived from fraud, trafficking, or other illegal conduct.
• Drugs or psychoactive substance offenses, including content that promotes, encourages, or attempts to buy, sell, distribute, or manufacture illegal drugs or controlled substances. This includes content involving the use, production, or sale of substances banned under applicable law, including so-called "legal highs" or other synthetic psychoactive compounds.
• Firearms, knives, and other weapons offenses, including content that promotes, encourages, or attempts to buy, sell, distribute, or use firearms, knives, explosives, or other weapons unlawfully. This includes content showing the unlawful possession, modification, or use of weapons, or providing instructions on how to create or obtain them.
• Encouraging or assisting suicide, including any content that promotes, glamorizes, or instructs others on methods of self-harm or suicide. This includes expressing intent to assist, urging someone to end their life, or sharing material that could reasonably be understood as supporting or facilitating suicide or serious self-injury.
• Foreign interference offenses, including content that supports or enables covert influence by a foreign power. This includes activity intended to manipulate public debate, distort information, undermine democratic processes, or interfere with elections or government institutions on behalf of or at the direction of a foreign entity.
• Animal cruelty, including any content that depicts, promotes, or encourages the abuse, torture, neglect, or killing of animals. This includes staged harm, real violence, or any content that may be reasonably understood to glorify or eroticize cruelty to animals, whether real or simulated.

Content Very Harmful to Children

The following must not be uploaded, shared, or generated directly on LoyalFans:

• Content that encourages, promotes, or provides instructions for suicide.
• Content that encourages, promotes, or provides instructions for an act of deliberate self-injury.
• Content that encourages, promotes, or provides instructions for an eating disorder or behaviors associated with an eating disorder.

While LoyalFans is not intended for children and access is restricted to adults, we do not permit content that poses a significant risk to mental health or safety under applicable law.

Other Content Harmful to Children

You must not upload, post, create on LoyalFans, or share any of the following:

• Content that is abusive and that targets any of the following characteristics: race, religion, sex, sexual orientation, disability, or gender reassignment.
• Content that incites hatred against people:
  • of a particular race (including color, nationality, and ethnic or national origins, religion (including lack of religion), sex, or sexual orientation;
  • who have a physical or mental disability; or
  • who have the characteristic of gender reassignment (meaning the person is proposing to undergo, is undergoing, or has undergone a process (or part of a process) for the purpose of reassigning the person's sex by changing physiological or other attributes of sex).
• Content that encourages, promotes, or provides instructions for an act of serious violence against a person.
• Bullying content.
• Content that:
  • depicts real or realistic serious violence against a person (real or not); or
  • depicts the real or realistic serious injury of a person (real or not) in graphic detail.
• Content that:
  • depicts real or realistic serious violence against an animal (real or not);
  • depicts the real or realistic serious injury of an animal (real or not) in graphic detail; or
  • realistically depicts serious violence against a fictional creature or the serious injury of a fictional creature in graphic detail.
• Content that encourages, promotes, or provides instructions for a challenge or stunt highly likely to result in serious injury to the person who does it or to someone else.
• Content that encourages a person to ingest, inject, inhale, or in any other way self-administer:
  • a physically harmful substance; or
  • a substance in such a quantity as to be physically harmful.

Offenses

You must not upload, post, create on LoyalFans, share, or cause any uploading, posting, creation or sharing, of any of the following:

• A grossly offensive, indecent, obscene, or menacing message intending to cause offense, menace, distress, or anxiety.
• A false message knowing it to be false, intending to cause non-trivial psychological or physical harm to a likely audience, and with no reasonable excuse.
• A message threatening death or serious harm while intending or being reckless as to whether the object of the threat would fear that the threat would be carried out.
• Flashing images when it is reasonably foreseeable that an individual with epilepsy will see it and the sender intended that the individual would suffer harm and the sender has no reasonable excuse for sending the images.
• A communication that intends to encourage serious self-harm.
• An unsolicited sexual image, including a manufactured intimate image or "deepfake" intending the recipient to be caused alarm, distress, or humiliation, or for the purpose of sexual gratification and being reckless as to whether the recipient will be caused alarm, distress, or humiliation.
• A sexually explicit deepfake.

Advertising and Promotional Content

You may share advertising or promotional content on LoyalFans, subject to the following requirements:

1. Truthful and Transparent Promotion
   • All advertising must be truthful, not misleading, and substantiated where appropriate.
   • You must clearly and conspicuously disclose any material connection between yourself and a brand, product, or service you promote. This includes receiving payment, free products, affiliate commissions, or other compensation.
   • Disclosures must be placed in a way that is unavoidable and easy to understand (e.g., using "Ad," "Sponsored," "Paid partnership," or equivalent language).
2. Prohibited Advertising

   You must not advertise, promote, or link to:

   • Illegal products or services, including counterfeit goods, unlicensed pharmaceuticals, or weapons.
   • Content that incites hatred, violence, or discrimination based on protected characteristics (e.g., race, sex, gender, religion, disability, age, sexual orientation).
   • Products or services that are unsafe or otherwise harmful to health, including any promotion of disordered eating or dangerous health practices.
   • Material aimed at, or likely to appeal to, minors. LoyalFans is an adults-only platform, and no advertising may target or exploit underage audiences.
3. Regulatory Compliance

   You are responsible for ensuring that all advertising content complies with applicable laws, including:

   • The FTC Endorsement Guidelines (U.S.)
   • The UK Online Safety Act 2023, particularly its provisions on harmful content and user safety
   • The EU Digital Services Act, including its transparency obligations regarding paid or commercial content
4. Advertising Declaration

   Where required by law or platform tools, you must accurately declare whether Content includes advertising or paid promotions. LoyalFans may require additional labeling or restrict promotional content that violates these terms.

Reporting and Enforcement

You may report violations of this policy in accordance with our Complaints Policy. Content that violates this policy will be removed. Users may also be suspended or permanently banned from LoyalFans.

Appeals

If your Content is removed or your account is suspended due to a violation of this policy, you may appeal our decision in accordance with our Appeals Policy.

Legal Notices and Disclaimers

U.S. Communications Decency Act (47 U.S.C. § 230)

LoyalFans operates under the protections of Section 230 of the U.S. Communications Decency Act. While we moderate content and provide appeal rights, we are not liable for user-generated content hosted on our platform, except as required under applicable U.S. laws.

EU Digital Services Act (DSA)

We will provide a clear statement of reasons for each content moderation or restriction decision and publish regular transparency reports in accordance with Article 15 of the EU Digital Services Act. Where applicable, we will also provide a link to certified out-of-court dispute settlement bodies.

Where content moderation decisions involve automated tools, we will disclose that automated moderation was used and provide information on your rights to object or request human review where required by law.

We will ensure that our appeals submission process is accessible to users with disabilities, in compliance with applicable accessibility laws, including the Americans with Disabilities Act (ADA) and the EU Accessibility Act.
